Michigan is an equitable distribution state, which means that the court has the discretion to award property in a divorce in a manner that the court deems fair. A property settlement is simply the division of property from the marital estate. Property settlements are set forth in your judgment of divorce, the document which declares your marriage dissolved and recites the terms of how your marital property must be divided.
If one party who is obligated to pay money or transfer specific property to the other fails to do so, there are legal means available to compel payment. This would be done in a post-judgment proceeding before the court.
